When players decide to choose to either opt in or out of the settlement plan the issue will be referred in the direction of the Federal judge in Minnesota. If a majority of players decide to not participate then the judge is able to restart talks between plaintiffs and the league, however, there is no time limit for that to happen.

There are some who believe an appeals court judge Paul Magnuson, will opt not to take both parties back to the negotiation table. When Magnuson agreed to the Madden NFL 24's settlement offer in April, he said:

"It must be said again: the people who initiated this suit and now are against the settlement rode into court with the intention of helping their fellow downtrodden brothers that had previously played for the N.F.L. yet today were penniless and often suffering from illness or injuries that directly related to their playing. It's an act of insincerity for the same plaintiffs to claim, like children denied dessert that the settlement did not give enough benefit to the players who filed the lawsuit."

The players who decide to opt out the settlement can then file personal lawsuits on behalf of the league. They could be more inclined to do this due to recent developments in the O'Bannon vs. NCAA case, too as former college athletes are suing over the use of their likeness to play video games.

In July in July, In July of this year, Ninth Circuit threw out an appeal filed by video game maker EA Sports. The decision rejected the argument of EA that player likeness were protected under the First Amendment and it will allow the appeal to proceed.

The Dryer plaintiffs are observing that case carefully. They're also keeping an eye on another suit that was filed by thousands members of the former Mut 24 coins player, over the issue of concussions.
